    New powers scheduled to come into force in 2010 will enable the Information Commissioner’s Office (ICO) to impose substantial monetary penalties on organisations where there is evidence of a reckless or deliberate data protection breach. The power to impose a civil monetary penalty on data controllers was created by section 144 of the Criminal Justice and Immigration Act 2008, which amended the Data Protection Act of 1988. The new powers are expected to be in force by April – and the Government has recently embarked on a consultation process to determine what the maximum financial penalties should be.
